1. Service Description
Teja is an AI-native practice management platform designed for mental health professionals. Our services include clinical documentation tools, appointment scheduling, client management, payment processing, telehealth, and related features ("the Service").
The Service is provided by Jhink LLC, a company registered in New York, operating under the trade name "Teja."
2. User Accounts
- You must be a licensed mental health professional or authorized practice administrator to create an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must provide accurate and complete information when creating your account.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in violation of any applicable law or regulation, including HIPAA.
- Share your account credentials with unauthorized individuals.
- Attempt to gain unauthorized access to other users' data or our systems.
- Use the Service to store or transmit malicious code or content.
- Interfere with or disrupt the integrity or performance of the Service.
4. Payment Terms
- Subscription fees are billed in advance on a monthly or annual basis.
- All fees are non-refundable except as required by law or as stated in our refund policy.
- We may change our pricing with 30 days' notice to existing customers.
- Payment processing is handled by Stripe. Your use of payment features is also subject to Stripe's terms of service.
- Failure to pay may result in suspension or termination of your account.
5. Intellectual Property
The Service and its original content, features, and functionality are owned by Jhink LLC and are protected by international copyright, trademark, and other intellectual property laws.
You retain full ownership of all content you create, upload, or store using the Service, including clinical notes, client records, and practice data.
6. Limitation of Liability
To the maximum extent permitted by law, Jhink LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
7. Termination
- You may cancel your account at any time through your account settings or by contacting us.
- We may suspend or terminate your account for violation of these Terms with notice.
- Upon termination, you may export your data for 30 days. After that, data will be deleted in accordance with our data retention policy.
- Sections that by their nature should survive termination (including limitation of liability, intellectual property, and dispute resolution) will survive.
8. HIPAA & Business Associate Agreement
Teja operates as a Business Associate under HIPAA. We will enter into a Business Associate Agreement (BAA) with all covered entities using our Service.
We implement administrative, physical, and technical safeguards to protect Protected Health Information (PHI) as required by HIPAA and the HITECH Act. See our Security page for details.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved in the courts located in New York County, New York.
